Ontario Electrical Contractor 15 Forms are issued with a number of schedules, which are templates designed specifically to simplify the process of filing a claim. There is a template for delivering a Notice of Claim to the surety, and a template for the surety’s response. This should eliminate the risk of submitting incomplete claims that only serve to drag out the adjustment process. These changes highlight the need to have the right partners on your team. “Knowledgeable surety representation is even more important during a period of evolving regulation, like we are in now,” offers Greg Petrela, President of Petrela, Winter & Associates, a surety and insurance brokerage which specializes exclusively in the construction industry. “A highly informed broker that specializes in the construction business will be able to monitor the development of the application of the new bonds and the Act, and that can mean the difference between a flawed and a successful claim.” Subcontractors should bear the following in mind: • Watch the Timelines. Prime and subcontractors both should be mindful that the new response requirements will impose a burden on them to relay critical claim-related information to the surety so those deadlines can be respected. Sureties are “staffing up” their claims department to be able to respond within the required timelines, and contractors will have a role to play in that process. • Which bond form? As a reminder, the new bond forms will only apply to public projects in the Province of Ontario. CCDC bond forms, federal bond forms, and private owner bond forms may still be used in other scenarios. The new Ontario forms will start to be required on public projects that begin the procurement process after July 1, 2018. • Different Regimes. Contractors throughout the province will be operating under both the old and new rules for some time. Document your contracts and files accordingly, with an eye towards filing a claim sometime in the future, so it is very clear which set of regulations apply. Trades should always ask the General Contractor for copies of the bonds when the project gets underway, and have the right to do so under the Act. • More bonding. For contractors that bid work directly to the Owner, and who would already maintain a bond facility, you might be expected to utilize that facility more frequently going forward. Now would be a good time to refresh yourself on a few of the key terms of your bond program, whether your limits are adequate, and whether you have the best representation available to work for you. Petrela, Winter & Associates specializes in providing bonding, insurance and advisory services exclusively to the construction industry.
